Please read our terms and conditions carefully before using our services.
These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between you (the "User," "you," or "your") and Digital Doctor Pakistan (the "Company," "we," "us," or "our"), governing your access to and use of our online platform and mobile applications (collectively, the "Platform") and the services provided through it.
BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE PLATFORM.
1. NATURE OF THE SERVICE (IMPORTANT DISCLAIMER)
1.1 Platform is a Facilitator
Digital Doctor Pakistan is a technology platform that connects Users with independent, licensed medical practitioners ("Doctors") registered and certified in Pakistan (e.g., with the PMDC). WE DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSES, OR TREATMENT OURSELVES. The medical care, advice, and prescriptions are solely the responsibility of the consulting Doctor.
1.2 NOT FOR EMERGENCIES
THE PLATFORM MUST NOT BE USED FOR MEDICAL EMERGENCIES. If you are experiencing a medical emergency, you must immediately contact local emergency services (e.g., 1122 or nearest hospital) or seek urgent physical care. The Company is not responsible for any delay in care caused by using the Platform for emergency situations.
1.3 Scope of Consultation
The Doctor will provide medical advice based solely on the information, symptoms, and medical history you provide during the virtual consultation. Telehealth services may not be suitable for all medical conditions, and the consulting Doctor retains the right to recommend an in-person examination or alternative care when necessary.
2. USER ELIGIBILITY AND ACCOUNT
2.1 User Requirements
To use the Platform, you must be:
- An individual at least 18 years of age and legally competent to enter into this Agreement; OR
- A legal guardian or parent seeking services for a minor under your custody (in which case, you assume full responsibility for all information provided and advice received).
2.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. USER OBLIGATIONS AND ACCURACY OF INFORMATION
3.1 Provision of Accurate Information (CRITICAL)
You agree to provide complete, accurate, and truthful information regarding your medical history, current symptoms, allergies, and any other relevant health data during your consultation. You acknowledge that failure to provide accurate information may result in inappropriate or ineffective medical advice or treatment recommendations, and the Company and its Doctors shall not be held liable for such outcomes.
3.2 Prohibited Conduct
You agree not to use the Platform for any unlawful purpose, including but not limited to:
- Uploading abusive, defamatory, or threatening content.
- Attempting to access other users' data or the Platform's core systems.
- Engaging in fraudulent activities, including false payment information or booking.
4. PAYMENT AND FEES
4.1 Consultation Fees
You agree to pay the fees for all services purchased on the Platform at the rates advertised at the time of booking. All fees are quoted in Pakistani Rupees (PKR) unless otherwise stated.
4.2 Payment Authorization
You authorize the Company, or its third-party payment processors, to charge your designated payment method for all applicable fees.
4.3 Cancellation and Refund Policy
a. Cancellation by User: If you cancel a consultation more than 05 (five) hours before the scheduled time, you may be eligible for a full refund. Cancellations made after this period, or "no-shows," may result in a forfeiture of the fee.
b. Cancellation by Company/Doctor: If a consultation is canceled by the Doctor or the Company, you will be offered a full refund or the option to reschedule.
5. CONFIDENTIALITY AND DATA PRIVACY
5.1 Privacy Policy
Your collection, use, and sharing of your personal and health information (PHI) are governed by our separate Privacy Policy, which is incorporated by reference into these Terms. By using the Platform, you consent to the data practices described in the Privacy Policy.
5.2 Data Security
We implement commercially reasonable security measures to protect your data; however, no transmission over the internet or method of electronic storage is 100% secure. You acknowledge this inherent risk in using the Platform.
6. INTELLECTUAL PROPERTY
6.1 Ownership
All intellectual property rights in the Platform, including the 'Digital Doctor Pakistan' name, logo, software, design, and content (excluding the content provided by Users or Doctors), are owned by the Company.
6.2 License to Use
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial healthcare consultation purposes as permitted by these Terms.
7. INDEMNITY AND LIMITATION OF LIABILITY
7.1 Indemnity
You agree to indemnify, defend, and hold harmless Digital Doctor Pakistan, its affiliates, officers, directors, employees, agents, and Doctors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms or your misuse of the Platform.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIGITAL DOCTOR PAKISTAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF:
- Your access to or use of the Platform or inability to access or use the Platform.
- Any conduct or content of any third party or Doctor on the Platform, including without limitation, any negligent advice, error, omission, or misdiagnosis.
- Any unauthorized access, use, or alteration of your transmissions or content.
8. GOVERNING LAW AND DISPUTE RESOLUTION
8.1 Governing Law
These Terms shall be governed by and construed in accordance with the Laws of Pakistan, without regard to its conflict of law principles.
8.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved through good-faith negotiation. If a resolution is not achieved, the dispute shall be finally settled by binding arbitration in Islamabad, Pakistan, in accordance with the provisions of the Arbitration Act, 1940, or any statutory modification or re-enactment thereof. The language of the arbitration shall be English.
9. GENERAL PROVISIONS
9.1 Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and Digital Doctor Pakistan regarding the use of the Platform.
9.2 Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform or by other reasonable means. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
